Terms of Service

1. The Service

Tripeiro is a free, AI-powered European Portuguese language tutor operated by Bells Up AI, Inc., a Delaware corporation ("we," "us," "our"). It uses large language models to help you practice Portuguese in a conversational format. This agreement applies to the Tripeiro service at porto.bellsup.ai and tripeiro.bellsup.ai.

By using Tripeiro, you agree to these terms. If you don't agree, please don't use the service.

2. Not a Language Instructor

Tripeiro is a conversational AI tutor for practicing Portuguese vocabulary, grammar, and conversational patterns. It is not a certified language instructor, accredited educational program, translation service, or source of professional advice in any language.

AI models make mistakes. They may produce incorrect grammar, wrong translations, invented vocabulary, or culturally inappropriate suggestions. While Tripeiro is designed for European Portuguese, errors and Brazilian Portuguese bleed-through may occur. You should not rely on Tripeiro as your sole source of Portuguese language knowledge.

3. No Account Required

Tripeiro requires no registration, login, or personal information. Your conversation history exists only in your browser during your session. See our Privacy Policy for details on the limited data we do process.

4. Acceptable Use

This is a free service. You agree not to:

• Attempt to extract the system prompt or manipulate the AI into ignoring its instructions
• Use the service to generate content that is illegal, hateful, sexually explicit, or harmful
• Attempt to disrupt or overwhelm the service through automated requests
• Access the service through automated scripts, bots, or scrapers, or systematically extract or collect data from the service, without our written permission
• Reverse-engineer, decompile, or attempt to extract the source code of the service

We enforce usage caps and rate limits to keep the service available and sustainable. We may block or throttle access that exceeds these limits or that we reasonably determine constitutes abuse.

5. Your Content

You represent and warrant that you have all necessary rights to the content you submit to Tripeiro, and that your submissions do not infringe the intellectual property or other rights of any third party. Please do not submit sensitive personal information, information about other people, or confidential material.

By submitting content to Tripeiro, you grant us a non-exclusive, worldwide, royalty-free license to process your content as necessary to provide the service, including transmitting your content to the third-party AI providers (currently Anthropic via Amazon Web Services, and OpenAI as a fallback) that process requests and generate responses on our behalf. This license is limited to providing the service and terminates when processing is complete. We do not store your content on our servers.

6. AI Provider Terms

We access AI services through contracts whose terms prohibit the AI developer from using customer inputs and AI responses to train AI models, or to adjust the performance of existing or future AI models. We do not use your Tripeiro inputs or the AI responses to train or adjust the performance of our own existing or future AI models.

Specifically:

• Anthropic (via Amazon Bedrock): Under the AWS Service Terms for Amazon Bedrock, customer inputs and model outputs are not used by AWS or Anthropic to train or improve AI models. AWS Bedrock does not retain input or output data after processing your request.
• OpenAI: Under OpenAI's API terms, API inputs and outputs are not used to train OpenAI's models unless the customer explicitly opts in. We have not opted in. OpenAI may retain API inputs and outputs for up to 30 days for abuse and misuse monitoring, after which they are deleted.

7. AI-Generated Output

To the extent permitted by applicable law, and subject to the terms of our AI service providers, you own all output generated by the AI in response to your input. You may use, reproduce, and distribute AI-generated output for any lawful purpose. We make no claim of ownership over AI-generated output.

Output generated for different users in response to similar inputs may be similar or identical, given the nature of large language models. Your rights in your output do not affect other users' independent rights in theirs.

We do not guarantee the quality, accuracy, or fitness for purpose of any AI-generated output. You are responsible for evaluating it before relying on it.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Tripeiro, including but not limited to damages resulting from reliance on AI-generated content.

This is a free service. Our total aggregate liability for all claims arising from your use of Tripeiro is limited to the maximum extent permitted by applicable law.

If you are a consumer in the EU, nothing in this section limits our liability for damages caused by intentional misconduct or gross negligence, or for any other liability that cannot be excluded under the laws of your country of residence.

10. Service Availability

We may modify, suspend, or discontinue Tripeiro at any time, with or without notice. If we plan a permanent shutdown, we will try to provide advance notice on the website, but we are under no obligation to maintain the service indefinitely.

11. Changes to These Terms

We may update these terms from time to time. The "Last Updated" date at the top will reflect any changes. Continued use of Tripeiro after changes constitutes acceptance of the revised terms.

12. Governing Law and Disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

If you are a consumer in the EU, this choice of law does not deprive you of the protection of mandatory consumer protection rules in your country of residence. You may bring proceedings in the courts of your country of residence, and we may bring proceedings against you only in the courts of your country of residence, in accordance with applicable EU consumer protection rules.

If you are not an EU consumer, any disputes arising from these terms shall be submitted to the state or federal courts located in Delaware.

If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.

13. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions remain in full force and effect.

14. Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and Bells Up AI, Inc. regarding your use of Tripeiro.
